TERMS OF PAYMENT
AUTHORITY TO ACCEPT PAYMENT TERMS
You warrant that you have the appropriate authority and power to validly accept these Payment Terms, which are applicable to the charged services that you request through the FE Network. You agree that you are able to and will meet your obligations in relation to these Payment Terms promptly, efficiently, diligently, professionally, and in accordance with any relevant laws. You represent and warrant that you are over 18 years old and have the legal capacity to contract in the country of your origin and/or domicile. If you are using a credit card, you represent and warrant that the credit card is issued in your name and that you will pay all charges incurred through the charged services.
Payments made on the FE Network by means of the online service payment process are performed through a secure website. However, you acknowledge and agree that Internet transmissions are never entirely secure or private, and that any message or information you provide through the FE Network website (including credit card information) may be read or intercepted by others. DeltaQuest Media will not have any liability for the interception, hacking, or other unauthorized access of information through the website by unauthorized third parties.
VERIFICATION OF INFORMATION
It is your sole responsibility to ensure that the transaction, credit card information, and all other details you provide in relation to your payments made through the online service payment process are correct. DeltaQuest Media will not have any liability for transactions which are incorrect as a result of inaccurate data or information provided by you, or which is otherwise caused by factors beyond the control of DeltaQuest Media.
USE OF THE ONLINE SERVICE PAYMENT PROCESS
You agree to use the online service payment process only for the purpose of paying DeltaQuest Media for the charged services or for making other payments to DeltaQuest Media, which DeltaQuest Media accepts through the online service payment process. You agree not to use the online service payment process for any improper, injurious, offensive, or unlawful purpose. You agree not to damage or disrupt the online service payment process. You are responsible for making your own assessment of the suitability of the online service payment process for achieving your purposes. You are responsible for providing all technology, hardware, software, and telecommunication facilities in order to access and use the online service payment process.
OUR RESPONSIBILITIES REGARDING THE ONLINE SERVICE PAYMENT PROCESS
DeltaQuest Media cannot warrant that the online service payment process and/or your use of the online service payment process will be faultless, immediate, continuous, and virus-free, or that information provided through the online service payment process will be complete, accurate, or up-to-date. DeltaQuest Media will endeavor, however, to ensure that the online service payment process is available at all times. DeltaQuest Media reserves the right to alter, suspend, or terminate the online service payment process temporarily or permanently at any time.
DISCLAIMER OF LIABILITY
To the extent permitted by law, except as expressly set out in these Payment Terms, warranties, representations, or guarantees (whether express, implied, or statutory) in relation to the online service payment process are excluded, including, without limitation, any warranty of fitness for any particular purpose. DeltaQuest Media will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind suffered or incurred by you in connection to the online service payment process. Subject to the provisions of this clause, if for any reason DeltaQuest Media is held to be liable to you in relation to this online service payment process, the total extent of DeltaQuest Medias liability will be to the extent permitted by law and be limited to:
- In connection with a charged service, the fees payable by you for that charged service; and,
- In connection with any other use of the online service payment process – up to USD150.
The exclusions and limits set out in these Payment Terms will also operate for the benefit of DeltaQuest Medias relevant suppliers, licensors, and agents that DeltaQuest Media uses to provide the online service payment process made available to you.
You agree to indemnify DeltaQuest Media in respect of any loss, damage, cost, or expense (including reasonable enforcement costs, whether incurred on a solicitor and own client basis or otherwise) suffered or incurred by DeltaQuest Media as a result of:
- A breach by you of any of your obligations under any terms and conditions which you have accepted into in relation to the online service payment process;
-Your intentional misuse of the online service payment process or the website;
-Your negligent acts or omissions; and,
-Any claim, suit, or action brought against DeltaQuest Media by a third party for any of the matters above.
REFUND POLICY AND ACCOUNT BALANCE TRANSFERS
DeltaQuest Media accepts payments by wire transfers, PayPal, Visa, MasterCard, or American Express credit or debit cards. Upon funding your account with DeltaQuest Media, you must make sure that the name of the payer is the same as the name of the Customer specified upon account opening. Payments from third parties will not be accepted. Since DeltaQuest Media is offering non-tangible, irrevocable services, and/or online products, we do not issue refunds once the order is placed and the services and/or products are delivered. As a DeltaQuest Media’s Customer, you are responsible for understanding this upon purchasing any item on the FE Network.
Any attempt to charge back or cancel a payment, which has been completed, will result in your account being closed. In the case of PayPal payments, if a PayPal dispute or claim is opened, your account will be disabled until the case has been resolved. If the case results in your funds being returned, your account will be closed. If a chargeback or claim results in your balance becoming a negative balance, we will take legal action to retrieve the negative balance and may involve a debt collection agency in your local area.
Dealing with chargebacks and claims is a time-consuming process. If you are not sure what you are purchasing, please do not make a payment, and contact us using the Support Centre or Contact link available in the footer on each page on the FE Network website to clarify any questions you may have.
Please note that we do not bear any responsibility and, therefore, we do not satisfy any refund/return/exchange requests based on incompatibility of our online system, software, and applications with some third-party software, plug-ins, add-ons, modules, search engines, scripts, extensions, etc. We do not guarantee that our system, software, and applications are fully compatible with any third-party programs, and we do not provide support for third-party applications. Our Technical Support team is always eager to assist you and deliver highly professional support in a timely manner. In case of any technical issue, or if you want to report an incompatibility problem, please contact us using the Support Centre or Contact link available in the footer on each page of the FE Network website.
You may at any time request your account with FE Network be closed and your account balance transferred to your bank account. In case of closure of your account with the FE Network, the funds can only be transferred in the same currency as currency of your account held with us. Funds can be withdrawn to the same bank account and/or by the same method used for funding your account with the FE Network. Upon withdrawal, the name of the beneficiary must be the same as the Customer’s name registered in your billing details. Any requests to make a balance transfer to third parties will not be accepted.
You may request a balance transfer only if your balance exceeds the minimum required bank transfer fees, being equivalent to USD 30 as applicable from time to time. Balance transfers apply to the whole balance in its entirety. We will not transfer a portion of a balance.
